1. The company's catalogues, price list and other advertising matter shall not form any part of any contract between buyer and company. Any price quotation by the company or its agents or employees shall be deemed to be for the purpose of information only and shall not constitute an offer to sell.

2. Unless otherwise stated in writing all prices quoted are exclusive of vat. Quotations are Valid for 14 days from issue date.

3. The company must be notified by e-mail or fax within 48 hours of delivery of any claims by the buyer of any shortage or damage to goods in transit. Risk in respect of the goods passes to the buyer from the moment of delivery.

4. Shading is an inherent quality of decorative stone cladding and the buyer must order the correct quantity for its requirements as the company cannot guarantee against crazing or shade variation. Corner pieces of the same product may slightly differ from flat tiles - please check shade match before use or install on the wall.

Installer should reasonably be expected to discover and therefore become aware of any such defect upon inspection, then if the planned installation proceeds we will not be responsible for any costs of installation or reinstallation, incurred by you or your contractor or other installer, which you may subsequently claim to have been necessary as a result of the defect.

5. As the number of tiles per square yard and a square meter is nominal the buyer will be responsible for ensuring sufficient quantity of tiles are ordered to cover the required area. We recommend that you add an additional 10% to cover waste and cuts.

6. Cancelled orders will incur collection and transport charges. We try to get your orders to you as quickly as possible and subject to stock and timings endeavour to get orders packed and dispatched the day the order arrives with us. If you cancel after your order is on the lorry there may be a charge to you for canceling the order to cover our expense in returning the pallet to the warehouse for resale.

7. Orders are accepted and promises for delivery given conditionally upon our being able to secure the necessary material, and without responsibility for delays arising through risks and uncertainties of manufacture, strike, accidents, or other causes beyond our control. Some of the products can not be delivered due to size of it and will be for collection at Grindley  warehouse please contact us for details (this is clearly stated at  products description)

8. All invoices will be dated the month the goods are dispatched from the factory or our warehouse, all amounts are strictly net. Extension of credit cannot be allowed.

9. In the event the payment is not made by the date, we reserve the right to recover from the buyer interest at the rate of 5% above the Bank of England base rate in existence at the time. Interest shall be payable from the original due date until the payment is made.

10.Failure to comply with the terms of payment will become payable forthwith, including any applicable interest.

11. The supply of goods does not mean that they are suitable for a specific installation. We can only be held responsible for any failure on the products supplied by us, to the extent that the manufacturer of such products is prepared to guarantee the same. No stone cladding, natural stone, brick slips, wood panels ( plaster or concrete ) are guaranteed against crazing.

12. Prices are subject to alteration without notice.

13. The company cannot, under any circumstances entertain any financial demands from the customer for late or incorrect delivery. As a company, we always recommend that you never book a tiler/fitter until you have the products delivered.

14. Our products will be shrink wrapped on a pallet and delivered to the ground level edge of your property. The driver will not be able to assist getting the tiles into your property due to insurance purposes. Orders under 5kg weight will be delivered by a parcel courier.

15. The cost of a sample brick slip, Natural Stone cladding is stated at the listing. Sample will come in half or quarter of the size of product. Only one sample is allowed per sample order.  Please consult our sales support team if you require a sample. We do not provide wood panels samples due to its size. We do not take responsibility for damage of samples caused by courier

16. We expect returned our products in a re-saleable condition. Therefore we recommend that you put the product back on the pallet they were delivered on, and securely fasten the tiles so they are not able to move around. It is always helpful in the event that damage may be caused in transit to take a couple of photographs before they are wrapped and when they are wrapped before they are collected. Because of batching issues etc, we can only accept returns within 14 days of the product being delivered.

17. We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific unauthorized actions against computer systems and data. We will investigate any such actions with a view to prosecuting and/or taking civil proceedings to recover damages against those responsible.

PLEASE NOTE - WE DO BEST AS WE CAN TO SHOW COLOUR AND SHADE OF PRODUCT AT THE PICTURES, DESPITE OUR EFFORTS TO REPRESENT THE PRODUCTS AS CLOSE TO THEIR REAL LOOK AS POSSIBLE, CHARACTERISTIC OF CAMERA ,  MONITOR (SCREEN) AND INDIVIDUAL COLOUR PERCEPTION CAN MAKE PRODUCT LOOK ONE SHADE OFF ITS REAL APPEARANCE. We do not take any responsibility the differences between online picture and real product colour shade. We always recommend to purchase sample first before placing order.

21. WARNING: Manufacturer or GP Protech shall not be liable for any consequences of incorrect tile application and all claims involving sizes or colors ‘as laid’ are expressly excluded.

INSPECTION 
On delivery the customer shall inspect all goods and ensure that they are correct in all respect and comply with the delivery note and the contract as to quantity, quality and specification and shall immediately notify the company in writing of all shortages and defects. The company is not liable for defects that should have been revealed upon such examination but not notified to it as set out herein. The customer shall notify in writing the carrier as well as the company as soon as possible and in any event within three days of receipt of goods damaged in transit. After delivery it shall be a precondition of any liability by the company that the customer notifies the company in writing of any defect.

THIRD PARTY MANUFACTURE 


Where goods are in whole or in part manufactured by a third party the company will so far as it is able assign its rights against the third party to the buyer The company shall not, unless the buyer expressly requests in writing prior to the contract that he requires the company to be liable, be liable for defects in goods or services not manufactured or supplied by it. The company is not obliged to check goods not manufactured by it prior to delivery but may rely on representation of the manufacturer or supplier. The buyer will if he sells good subject to this clause include a similar term to this in his conditions and duly notify the company in writing of a request to hold liable as contractor and will keep the company indemnified against all actions and claims brought by third parties against the company in respect of goods sold or supplied by it.

Our Liability

 

a. we shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Contract; and

b. our total liability to you in respect of all other losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the price of the Products you have purchased.

c. If you intend to install a Product you have purchased from us through a contractor or other installer and, prior to the installation, you are aware of a defect as referred to under clause 3, or your contractor or installer should reasonably be expected to discover and therefore become aware of any such defect upon inspection, then if the planned installation proceeds we will not be responsible for any costs of reinstallation, incurred by you or your contractor or other installer, which you may subsequently claim to have been necessary as a result of the defect.

5d. Nothing in these terms and conditions shall limit or exclude our liability for:

a. death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors (as applicable);

b. fraud or fraudulent misrepresentation;

c. breach of the terms implied by section 12 of the Sale of Goods Act 1979;

d. defective products under the Consumer Protection Act 1987; or

e. any matter in respect of which it would be unlawful for us to exclude or restrict liability.

22. This does not affect your statutory rights

Any claims will be proceed by manufacturer not by GP Protech Limited. GP Protech Limited will inform manufacturer about defect and decision will be made by Manufacturer then pass over to the client.

Business to business Terms and Condition Trade Sale

1.Returns

(a)Refunds may occasionally be offered at the discretion of the company. 
(b)GP Protech Limited for business purchases, credit of the full price paid less any shipping costs and less a 25% restocking charge will be paid for returns of standard stock items only if notified within 48 hours via email or fax. Returned goods must be unused, in their existing packaging, undamaged and sent to our warehouse at the purchasor`s expense. Any items which are ordered on special order will not be eligible for return.

2.SUBSTITUTION 

Due to external forces/geographical location/or extraordinary demand certain items may not be available ex stock at certain times. In such cases the customer will be informed of delivery delays/alternative products available, and be given the opportunity to cancel their order and receive a full refund should they wish not to wait or accept the alternative product in substitution.

6. Delivery & Returns

Brick slips and Natural stone cladding / tiles, wood panels will be shrink wrapped on a pallet and delivered to the ground level edge of your property (curb side). The driver will NOT be able to assist getting the goods into your property due to insurance purposes.

Please note: We use UPC Network delivery service ( Economy - Book in service ) – We work closely with our third party delivery company to provide the best possible delivery service for our customers at a reasonable cost, although please remember they are not fully under our control. We do strongly recommend that you should order your tiles well in advance of your planned installation date and we will not under any circumstance be held liable for financial losses resulting from late or incorrect deliveries.

Book in service meaning - your local UPC depot will contact you to arrange best date and day for delivery, which is suitable for you. Time slots may not be offered ( please discus this with you local depot).

We can dispatch by premium next day service ( not guaranteed) - please contact us for details and price quotation.

All of our deliveries go via a third party haulier, operating a hub system.

Most of our deliveries are made on pallets and these will always be delivered “kerbside”.This means your tiles will be left secured to the pallet at the nearest external location to the property which has a flat hard surface leading from the delivery vehicle.

They are generally delivered on 18 tonne lorry with a tail lift, and offloaded using a pallet pump truck, unless you stipulate that there is a forklift truck on site. Please be aware the delivery is made by a third party delivery company and the driver will not be able to assist in unloading the pallet or helping to bring the goods inside your property. They will not enter the premises for insurance purposes.

Please contact us immediately if there is restrictions to access for 18T lorry.

Your local depot may refuse delivery if there is restrictions for 18T lorry. They may offer alternative delivery on smaller VAN, but there may be extra delivery charge. You may speak with your delivery depot for available options.

Some tile boxes weigh in excess of 20kg each and we recommend ensuring you have arranged help on the day of delivery if you need it.

Please make sure that the delivery site has no access restrictions for this size lorry or limitations on weight to the site, ie road weight restrictions and bridges. Please be aware that the outer dimensions are not the same for every lorry as stone are a heavy product they must be delivered with a hydraulic vehicle that has a high roof and cannot reverse into a drive.

A tail lift and pump truck is used to off load the pallets. A flat, hard surface is required in order to do this. Other obstacles such as over-hanging branches, other cars etc must also be considered. Any surface such as grass, shingle, cobbles etc will prevent off-loading. Slopes and high curbs may also cause issues.

The delivery will take place on a specified day, but unfortunately we cannot supply a time for delivery. We do ask that they call the contact on site half an hour before delivery, so if this is helpful, please provide a name and number as appropriate on your purchase order. This is not a guaranteed service however, so there will need to be somebody on site to receive the goods.

On arrival of the pallet, please make sure that all goods are in tact. If you see any potential or actual damages, or the packaging is not in tact, please mark ‘Damaged’ on the delivery note , take picture if possible and contact us straight away. This enables us to start damage claim process.

Please be aware that if the hauliers are not able to deliver, or the information supplied is not correct and delivery is ultimately not made, the pallet will be withdrawn and a re-delivery charge will incurred before the pallet is brought back to site.

IF YOU NOT RECEIVE YOUR GOODS WITHIN  5 DAYS - PLEASE CONTACT US IMMEDIATELY.

SAMPLES:

We dispatch samples ( subject to availability) within 48 hours for orders placed till 1pm + transit time selected by buyer ( please note we do not take any responsibility for delivery delays due to we do not have control over carrier companies).

When ordering Tiles / brick slips / Natural stone cladding, stone cladding samples, you will receive a small cut sample either 10cm x 10cm or 15cm x 15cm or full stone cladding or brick slip as in product specification.

RETURNS:

You can return products at your own cost within 14 days from date of delivery except products purchase on special order or trade sale.

If you wish to return any goods to us, it must be returned to us in re-saleable condition, in its full original carton/box and the range is still for sale via our website.

There will be a restocking charge of 10% of the goods returned. If you require GP Protech to arrange the collection of brick slips, Natural stone, stone cladding to be returned, the cost of haulage will also be deducted from the total refund (these costs can all be agreed before deciding if you want to return your brick slips, Natural stone , split face or Stone cladding).

If the goods are not in a re-saleable condition when they arrive back with us, GP PROTECH LIMITED reserve the right to amend the amount of the refund based on the value of re-saleable goods.

If you decide to return an entire order, costs will need to be deducted for the delivery, and the return costs.

DISPATCH TIME:

We usually dispatch in stock products within 1-2 working days from purchase day. Out of stock products may be dispatch between 10-20 working days Most of products are available for next day delivery. We will inform you about estimated dispatch day by sending email, alternatively you can contact us using contact form to check availability before place an order.

We can not take responsibility for delivery time when it is not depending on us. That is why do not book any tiler or fitter before products arrive to your site.

RECEIVING GOODS:

Please make sure you check condition of products before sign delivery collection and make note on delivery note if you will see signs of damage. Take pictures if possible and inform us immediately.

ADDITIONAL CHARGES:

For delivery to Scotland, Northern Ireland, Channel Islands, Isles of Man, Isles of Wright please contact customer service due to additional cost may apply.

Please spend responsibly – Borrowing beyond your means could seriously affect your financial status, ensure you can afford to make your repayments on time by the due date.

Failure to make payment on time could result in your debt being passed to a debt collection agency and affect future lending decisions made by Klarna.

STEGU Manufacturer WARRANTY TERMS AND CONDITIONS


“STEGU” Spółka z ograniczoną odpowiedzialnością (hereinafter: “Stegu”) to enhance customer satisfaction hereby
extends a warranty (hereinafter: “Warranty”) on concrete façade tiles (hereinafter: “Products”), subject to the
terms and conditions as set out below:
1. Stegu guarantees that the Products are free of technological defects and, therefore, Stegu’s liability under the
warranty is limited to defects caused by inherent faults in the Products (hereinafter: “Defect”) which will
manifest within 10 years of the date of the Product purchase (hereinafter: “Warranty Period”).
2. The warranty becomes valid and effective on the Product purchase date.
3. Flaws are not considered Defects if they result from:
a) faulty product application, including but not limited to faulty surface preparation; faulty Product
installation; lack of grouting; failure to follow Stegu’s recommendations on the packaging and/or Stegu
website /STEGU.pl/; or choosing the particular adhesive or grout manufacturer, etc.;
b) application of the Product contrary to its intended use;
c) damage caused by external events, such as mechanical damage;
d) improper Product storage or transport conditions;
e) other reasons not related to Defects, but inherent to the Product.
4. Under these Warranty Terms and Conditions, the following shall not be considered Defects:
a) natural calcium blooming appearing as concrete matures or other natural occurrences;
b) differences in the Product surface texture not affecting the Product technical parameters;
c) surface staining caused by external factors.
5. Stegu would like to inform you that Products of the same kind may differ in colour, especially because of
being manufactured at various time intervals /different production lots/, which differences are not considered
Defects but are a natural consequence of variations /of properties/ in the ingredients /raw materials/ used in the
manufacturing process.
6. If a Defect is revealed, Stegu will remove it at its own cost and expense either by making a refund of the Product
purchase price in the portion affected by the Defect or by replacing the defective product with a defect-free
one in the portion affected by the Defect.
7. A warranty claim will be processed if:
a) a written request is submitted substantially in the form annexed to these Terms and Conditions with a
photocopy of an invoice, bill or other proof of the Product purchase;
b) the request in paragraph a) is submitted immediately after the Defect occurs, no later, however, than within
one month of detecting the Defect, after which time the Warranty expires.
8. If any Defect is revealed in the Product, you should stop its application /unless the Defect occurs after
installation/ and report the Defect immediately in accordance with Section 7 as follows: by sending an email
to reklamacje@stegu.pl.
9. The Defects reported will be dealt with within 14 days starting from the date on which Stegu receives a
complete and correctly filled in questionnaire referred to in Section 7 paragraph a).
10.Before making its final decision on the Defects reported in the warranty claim, Stegu reserves the right to
inspect the defective Products, take their samples or perform laboratory tests on them or other similar
activities and in such a case the handling time of the reported Defects may be extended to allow for the
performance of such activities, by no more, however, than another 30-day period.
11.If the defective Product is replaced with a defect-free Product, the warranty term will renew upon delivery of
the new Product.
